Terms of Use
Preamble
The purpose of these Terms of Use is to define the conditions under which the company Your Flavourist, as identified above, grants a user a non-transferable and non-exclusive right to use the information published and the content of the website for the whole world.
Acceptance hereof is materialized in particular by the use of the Website.
Access to the website
Anyone can access the Website, as soon as they have an Internet connection, and thus benefit from certain free information.
The user declares to be aware of the risks associated with the Internet and acknowledges that the data exchanges circulating on the Internet benefit from relative reliability and are therefore not protected, in particular against the risks of hijacking and hacking and that the technical performance of the network Internet, as well as the response time to consult, interrogate or transfer information are variable and random.
The user alone will assume all costs that may be claimed by the mobile operator related to access to the connection services necessary for the use of the Website.
The website works optimally only on recent browsers, excluding Internet Explorer. Furthermore, the website uses JavaScript technology, so the user must ensure that their browser does not deactivate this technology, otherwise the majority of the functionalities will remain inaccessible to the user.
The user must ensure the compatibility of their technical environment with the website.
Availability of the Website
Your Flavourist strives to ensure the availability of the website 24 hours a day, 7 days a week. However, access to the website may be interrupted, in particular in the context of maintenance operations, upgrades or updates, emergency repairs, or as a result of circumstances beyond the control of Your Flavourist.
Intellectual property
All the content accessible via the website (texts, codes, comments, works, illustrations, images, etc.) as well as the website itself are protected for the whole world, by copyright and by the law protecting the databases of which Your Flavourist is the producer.
This content may therefore not in any way be the subject, even partially, of reproduction, representation, loan, exchange or transfer, total or partial extraction of data and/or a transfer to another medium, or modification, adaptation, arrangement or transformation, other than under the conditions below.
Only a right of use, to the exclusion of any transfer of ownership of any kind, for the perimeter declared and accepted by Your Flavourist is granted to the user. The only authorised reproduction and representation of the content as authorised by the Intellectual Property Code on a screen for strictly personal benefit are therefore authorised. In addition, the user refrains from reconstituting the database(s), from redistributing the content, for any reason whatsoever, and more generally from directly or indirectly or through third parties, in any way, to the rights of Your Flavourist.
Your Flavourist reserves the right to have any mandate carried out by any mandate they considers necessary, at the expense of the user if a breach is found, in order to verify that the Terms of Use and the agreed scope are respected.
Processing of personal data
Your Flavourist undertakes to implement the appropriate measures to ensure the protection of personal data and to process and use such data in compliance with the applicable provisions and in particular the European Regulation 2016/679 of April 27, 2016 and of the amended French law n°78-17 of January 6, 1978, known as the "Data Protection Act" -"Loi Informatique et libertés".
The data are subject to computer processing by the company Your Flavourist acting as data controller, the purpose of which is provided for in the Data Protection Policy, available on the website (below under "Data protection").
The data is kept for the period strictly necessary for the accomplishment of the purposes stated in the Data Protection Policy.
For the strict needs of the management of commercial relations, this data may be communicated to our partners, in accordance with the Data Protection Policy. Any natural person has the rights of access, rectification, erasure, data portability as well as limitation and opposition to the processing and organisation of the fate of their data after their death. These rights can be exercised in accordance with the terms set out in the Data Protection Policy.
In the event of exercise of the right of opposition, all communication with the user will cease.

General provisions
The Terms of Use can be viewed online and can be modified at any time at the discretion of the Service Provider without any formality other than posting them online, only the latest version will apply.
Failure to claim the application of one of the provisions of the Terms of Use or to agree to its non-performance, either permanently or temporarily, cannot be interpreted as a waiver of this right.
If any of the clauses of the Terms of Use were declared void, it would be deemed unwritten but would not invalidate all of the Terms of Use.

Your Flavourist will make its best efforts to answer any question as soon as possible.
These Terms of Use and the operations resulting from them are governed by French law. In the event of a dispute, the Paris Commercial Court will have sole jurisdiction, even in the event of summary proceedings, warranty claims or multiple claimants.
These Terms of Use are written in French and English. In the event that they are translated into one or more languages, only the French text will prevail in the event of a dispute.

Data Protection
Responsible for collecting personal data
The person responsible for the processing of personal data is Mr. Paul Rey-Fauvinet, Managing Director of Your Flavourist.
As responsible for processing the data it collects, Your Flavourist undertakes to comply with the framework of the legal provisions in force. It is their responsibility in particular to establish the purposes of their data processing, to provide their prospects and customers, from the collection of their consents, with complete information on the processing of their personal data and to maintain a processing register compliant to reality. Whenever Your Flavourist processes Personal Data, they take all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which Your Flavourist processes it.
Purpose of the personal data collected
Your Flavourist may process all or part of the data:
- To allow navigation on the website,
- To prevent and fight against computer fraud (spamming, hacking): computer equipment used for browsing, IP address,
- To improve navigation on the website: connection and usage data,
- To conduct optional satisfaction surveys,
- To conduct communication campaigns by email or SMS using the email address or phone number.
Your Flavourist does not sell your personal data which is therefore only used out of necessity or for statistical and analytical purposes.
Right of access, rectification and opposition to personal data
In accordance with current European regulations, Users of the website have the following rights:
- Right of access and rectification, updating, completeness of user data, right to block or erase user personal data, when they are inaccurate, incomplete, equivocal, out of date, or of which the collection, use, disclosure or storage is prohibited,
- Right to withdraw consent at any time,
- Right to limit the processing of user data,
- Right of opposition to the processing of user data,
- Right to portability of data that users have provided, when this data is subject to automated processing based on their consent or on a contract,
- Right to define the fate of users' data after their death and to choose to whom Your Flavourist must communicate (or not) their data to a third party that they have previously designated.
As soon as Your Flavourist becomes aware of the death of a user and in the absence of instructions from them, they undertakes to destroy their data, unless their retention is necessary for evidentiary purposes or to meet a legal obligation.
If the user wishes to know how Your Flavourist uses their personal data, ask to rectify them or oppose their processing, the user may contact Your Flavourist by post or e-mail or by telephone to Mr Paul Rey-Fauvinet, Managing Director and DPO, whose contact details are given in the "Identification" section.
In this case, the user must indicate the personal data that they would like Your Flavourist to correct, update or delete, by identifying themselves precisely with a copy of an identity document (identity card or passport).
Requests for the deletion of personal data will be subject to the obligations imposed on Your Flavourist by law, in particular with regard to the preservation or archiving of documents. Finally, users of the website can file a complaint with the supervisory authorities, and in particular the French CNIL (cnil.fr/fr/plaintes).
Non-communication of personal data
Your Flavourist is prohibited from processing, hosting or transferring the information collected on its clients to a country located outside the European Union or recognised as "unsuitable" by the European Commission without first informing the client. However, Your Flavourist remains free to choose its technical and commercial subcontractors on the condition that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulations.
Your Flavourist undertakes to take all necessary precautions to preserve the security of information and in particular that it is not communicated to unauthorised persons. However, if an incident impacting the integrity or confidentiality of client information is brought to the attention of Your Flavourist, it must inform the client as soon as possible and notify them of the corrective measures taken. Moreover, Your Flavourist does not collect any "sensitive data".
The user's personal data may be processed by subsidiaries of Your Flavourist and subcontractors (service providers), exclusively in order to achieve the purposes of this policy.
Types of personal data collected
Regarding the users of the website, we collect the following data only in the context of the use of the contact form, which will be kept for a maximum period of 12 months after the contact is made:
- Identity of the person: surname, first name
- Professional information: employer, field of activity
- Contact information: email address, telephone number
The website uses analytical cookies for statistical purposes only: audience measurement, geographical origin of our visitors, duration of visit, etc. Under no circumstances does the website use either read or write cookies containing personal or professional information of the user.
